    Özet

    Güçsüz durumdaki bireyin, kamusal gücü kullanan devlet karşısında nasıl korunacağı önemli bir soru olarak kadim bir tartışmadır. Bireyin korunması ve devletin sınırlanması, devletin denetlenebilir hale getirilmesiyle ilgilidir. Devletin hukuka uygun hareket etmesi, istediği zaman ve istediği ölçüde değil, her zaman, her işlemde, süreklilik arz etmesi gerekliliği ilkesi hukuk devleti kavramı ile ifade edilmektedir. Bu çalışmada insanlık tarihinde kralların hukukundan hukukun krallığına geçişi ifade eden ‘hukuk devleti’ ilkesi unsurları değerlendirilmektedir.

    Abstract

    The question of how powerless individuals will be protected against the state that uses public authority is an important and an ancient one. Protection of individual and Iimitati.on of state has to do with making the state controllable. Functioning of the state in accordance with law is something that must be sought perpetually and in every act rather than according to its own needs and measures is expressed with the concept of “the state of law”. in this article we will evaluate the elements of this principle which represents a transition in the human history from the law of kings to the kingdom of law.
